Mr. Hales acts as counsel to businesses, nonprofit organizations and health care providers including the HITECH revisions to HIPAA. Specific topics include corporate compliance, corporation, limited liability company and partnership formation, the drafting and negotiation of contracts, employment issues, government regulation, real estate and and other business matters including application of Sarbanes-Oxley requirements that apply to privately held companies and nonprofit organizations in two notable areas (whistle-blower protection and document retention.

Wills, Trusts and Estates

Mr. Hales helps individuals, families and their financial advisors create estate plans that will protect their loved ones and ensure that their assets are preserved to be used as they intend. For some, this may mean the drafting of a simple will, durable power of attorney, durable health care power of attorney and living will (advanced directive). He also drafts more complicated trusts including revocable (inter vivos) trusts, credit shelter (AB) trusts (see.pdf article on left), Grantor Retained Annuity Trusts (GRAT), Charitable Income Trusts including Charitable Remainder Unitrusts (CRUT) and Charitable Remainder Annuity Trusts (CRAT), irrevocable life insurance trusts, supplemental needs trusts also known as special needs trusts or family limited partnerships and limited liability companies.

Litigation, Mediation and Arbitration

Mr. Hales handles civil matters for both plaintiffs and defendants including accident, negligence and medical malpractice matters, family law matters including divorce, immigration, and civil rights matters including disability rights. He represents clients in litigation, arbitration or mediation.
